Shared Custody

Would a student be ineligible for services with a custodial parent with stable housing and a non-custodial parent ‘doubled up’? Custody arrangement is as close to 50/50 as possible with a custodial parent only identified for ‘school purposes’. Non-custodial has entered an economic hardship and is currently ‘doubled up’. Would the student(s) meet the criteria for McKinney-Vento? Student(s) spend 2/3 of the 5 school days with the non-custodial parent and non-custodial is only requesting assistance with transportation.
