McKinney-Vento eligibility depends on a student’s living situation, not on legal guardianship or power of attorney. If children live with their grandfather in safe, stable housing as a permanent family choice, they most likely would not qualify. If they are with him because their parents cannot provide housing or due to hardship, they may qualify as McKinney-Vento, even if the arrangement has lasted for years. The key is both the reason for the move and whether the grandfather’s housing is fixed, regular, and adequate.
