Change of Custody

I have a student who was eligible for McKinney-Vento when they were in mom’s custody. The courts have now given custody to dad- in another county. Is this child still McKinney-Vento? We are an ISD and cover both counties. I know if she was still with mom and they found a home, they would still be MV for the rest of the school year. Is it the same with the change of custody?

Hi Amy S (AmySura)! Great question! Yes, if they were identified during the current school year the student would remain eligible for the whole school year regardless of the custody or where they live now. You will reevaluate their nighttime residence at the beginning of next year.
