Are they still McKinney Vento?
I had a mother who was evicted and moved to a different town to live with a friend. We have been providing transportation for the year. During this time she has threatened to move out of her friends multiple times. I just learned that she has indeed moved out and is living with somebody else which is where her benefits check is being mailed to. The problem is that this residence is another completely different town. Is she still our student or should she enroll where her benefits are being sent to where she currently resides.

Just want to check: Have you completed a re-determination of McKinney-Vento eligibility for the upcoming school year? As a reminder, eligibility is assessed every school year and based on whether the student’s current living arrangement is fixed, regular, and adequate.
If the student(s) remain McKinney-Vento eligible, they have the right to continue attending your district as the school of origin, with transportation provided if needed to remove barriers to attendance, even if the new temporary residence is located in another town. However, if the new living arrangement is determined to be permanent and stable, McKinney-Vento protections would no longer apply, and the student would generally be expected to enroll in the district of residence.
In addition to assessing eligibility, it would be important to have a conversation with the parent or guardian regarding a Best Interest Determination, particularly if the new residence is significantly farther away. This discussion should consider factors such as travel time, the student’s educational needs and continuity, and any siblings who may be attending different schools. Each student’s school placement should be determined individually based on what is in their best interest.
